CCTV Policy
Maneechan Seethao (referred to as "Maneechan Seethao", "we" or "our") has installed and used CCTV equipment to monitor the area inside and around the premises, buildings, to protect the life, health and property of service recipients, contacts, personnel in, contractors, employees or any persons who enter the area monitored inside the building and premises via CCTV cameras (collectively referred to as "you"). As a personal data controller, we are legally required to explain this document to you about the reasons and methods of collecting, using or disclosing your personal data, including informing you of your rights as a data subject. We confirm that we have acted in accordance with the Personal Data Protection Act to protect your personal data, as will be discussed in this CCTV Privacy Policy, hereinafter referred to as "CCTV Privacy Policy" with details as follows:
1) Types of Personal Data Collected
Collect still images, moving images of you, and images of objects or other information that can identify an individual when you enter the area under surveillance within the building and premises via CCTV cameras.
2) Methods of Processing Your Personal Data
2.1) May collect, use, disclose or process your personal data for the following purposes:
• To inspect and maintain security within the building or premises of and assess security risks, including entry and exit to work at the premises of, exchanging cards to enter and exit the building or premises of and recording data on entry and exit of the premises of and recording images inside the building or office or surrounding area via CCTV cameras.
• To maintain the security of employees, service users and other persons entering the building and premises Including taking care of your property to prevent unrelated persons from entering or leaving restricted areas.
• To protect your health and safety, including your property.
• To protect buildings, premises and property from damage, disruption, destruction of property and other crimes.
• To support law enforcement agencies in obstructing, preventing and detecting crimes, including prosecuting when crimes occur.
• To comply with the law as requested by government agencies with legal authority or to use as evidence in the event of a crime or accident occurring within or around buildings and premises.
• To assist in the effective dispute resolution process.
• To assist in investigations or proceedings related to whistleblowing.
• To support the establishment of rights or raise as a defense in legal proceedings, including but not limited to civil cases and labor cases
• For any other actions to comply with the purpose of installing CCTV cameras as specified in this policy
2.2) CCTV cameras work 24 hours a day, except in cases of system failure or system maintenance.
2.3) Signs have been installed to warn about the use of CCTV cameras and the recording of your personal data in areas under reasonable supervision.
3) Legal Bases
We may collect, disclose or process your personal data based on the following legal bases:
• Vital Interests The collection, use, disclosure or processing of personal data is necessary to prevent or suppress a danger to the life, body or health of an individual.
• Lawful Interests The collection, use, disclosure or processing of personal data is for the legitimate interests of the Company in order to achieve one of the purposes specified above.
• Legal Obligations We are required to comply with the duties imposed by law, including laws on workplace safety and environment. We consider the use of CCTV cameras as an important measure to help comply with these requirements.
4) Disclosure of your personal data to third parties
4.1) We may disclose your personal data to third parties (including our affiliates and service providers) where we deem it necessary to disclose such personal data for the purposes specified above.
4.2) We may disclose your personal data to law enforcement agencies where necessary to perform our legal duties and to support or assist law enforcement agencies in preventing, investigating and prosecuting crimes.
5) Duration of retention of personal data
We will retain your personal data for the period necessary to comply with the purposes notified to you or for the period specified by law or the statute of limitations or for the exercise of legal rights. Upon expiration of the retention period, we will delete the data from our systems and records, or destroy the personal data, or anonymize the personal data.
6) Your rights
You have rights over your personal data under the Personal Data Protection Act.
• 6.1) Right of Access You have the right to access and request a copy of your personal data or request the disclosure of your personal data by notifying your intention in writing and sending it to the channels specified in the "Contact" section. Your request will be considered within the time frame specified by law. We may refuse to comply with your request if the request may affect the rights and freedoms of other persons, as required by law or by court order.
• 6.2) Right to Correction You have the right to request that the personal data that has been processed about you be corrected to be complete, accurate, not misleading and up-to-date.
• 6.3) Right to Data Portability You have the right to request that your personal data be sent or transferred to another data controller by automated means and to request that personal data sent or transferred directly to another data controller, unless technically impossible.
• 6.4) Right to object You have the right to object to the collection, use or disclosure of your personal data, which is for the purpose of achieving the legitimate interests of (or another person's) and may refuse to comply with your request if it can be shown that there are legitimate grounds for the collection, use or disclosure of such personal data that are overridden by your interests, or if the collection, use or disclosure of such personal data is for the establishment, exercise or defence of legal claims.
• 6.5) Right to erasure or destruction of data You have the right to request that your personal data be erased or destroyed, or that your personal data be anonymized, if you believe that (1) the personal data is no longer necessary for the purposes specified in this Notice, or (2) your personal data has been unlawfully collected, used or disclosed. You may refuse to comply with a request to erase or destroy your personal data for the establishment, exercise or defence of legal claims, or the enforcement of legal claims.
• 6.6) Right to restrict processing You have the right to request that the use of your personal data be suspended if you believe that the retention of such personal data is no longer necessary for the purposes set out in this Notice, but you still want to retain such personal data for the establishment, exercise or defence of legal claims, or the performance of legal obligations.
• 6.7) Right to withdraw consent You have the right to withdraw your consent at any time, except where such withdrawal is restricted by law or a contract that benefits you. Such withdrawal of consent will not affect the lawful processing of your personal data to which you have previously given your consent.
• 6.8) Right to lodge a complaint You have the right to lodge a complaint with a data protection supervisory authority if you believe that there has been a breach or failure to comply with any of the duties of the Data Protection Act.
